Program Description

As the July 1, 2020 enforcement date with the California Consumer Privacy Act (CCPA) rapidly approaches, the first wave of class actions referencing the CCPA have been filed. In addition, the impacts of COVID-19 have forced businesses to make fast decisions that require balancing their interest in protecting the health and safety of others with data privacy and security concerns. This program will discuss CCPA litigation to date, potential enforcement risks under the CCPA, how to manage compliance obligations to minimize litigation risk, and increased business risks to consider during negotiations and drafting contracts in a pandemic environment.

Learning Objectives

At the end of this session, participants will have a better understanding of:

  • The new privacy rights and obligations created under the CCPA;
  • The applicable deadline for enforcement of the CCPA, and whether the California AG is likely to extend such deadline;
  • The number and types of cases filed to date under the CCPA;
  • How these cases can assist in identifying the business and litigation risks created by the CCPA, and building an effective CCPA compliance program; and
  • How the negotiation and drafting of contracts can also assist in managing the risks created by the CCPA and the global pandemic more broadly.
