Program Description

This course reviews Section 230 of the Communications Decency Act (CDA), which provides immunity for online service providers that host third-party content for any resulting liability.  We take a look at the language and history of the CDA, as well as the notable caselaw.  We then provide tips to in-house counsel who might be considering CDA immunity when advising their companies about risk related to different online activities.  Finally, we examine the future of the CDA and changing public sentiment regarding online platforms.

Learning Objectives

At the end of this session, participants will obtain actionable advice for in-house counsel about online liability.
