Program Description

Employment law experts from Orrick discuss recent trends and new laws across a range of evolving areas of law including pay equity, California’s new independent contractor law (AB5), post-employment restrictive covenants and the Department of Labor’s new overtime rules. With regards to pay equity, the #MeToo movement has brought the issue of pay equity and the pay gap front and center—and many states are passing new laws.

Meanwhile, the rules around post-employment restrictive covenants—such as non-competes and non-solicits—are creating big challenges for companies, particularly as states adopt different standards. Further, California’s new independent contractor law (AB5) creates a challenging three-prong test for classifying an independent contractor with complicated exemptions and minimal guidance. And as it relates to working overtime, the U.S. Department of Labor has issued new overtime rules with, among other changes, an increased minimum salary test for exempt employees.
