Despite several rounds of amendments to the Federal Rules of Civil Procedure, parties and the courts still struggle to achieve proportionality. In addition, new privacy laws including the GDPR have created additional burden and cost. This session will discuss on-going advocacy by the defense bar to continue to drive for further changes in the rules and Amicus Brief activity to help ensure the case law develops consistent with the spirit of changes to the rules. This session will also offer tips and best practices in managing discovery.
Participants will learn about the activity with the Rules Committee and other initiatives to drive further change around MDL rules, 30(b)(6), and proportionality, as well as better understand the practical implications of GDPR and best practices to manage discovery risk and spend.
